Security Deposits

The pathway to a full refund hinges on the resident’s fulfillment of obligations outlined in the lease agreement, rooted in the framework of the Texas Property Code. Fundamentally, a security deposit is defined as an advance of money primarily intended to secure performance under a lease. The Property Code grants the landlord the right to deduct for damages or charges for which the tenant is legally liable. To ensure a deposit refund, the tenant must surrender the premises after leaving the property in the same condition as received, ordinary wear and tear excepted, and provide a written statement of their forwarding address. All properties offered by Simply Rentals are professionally cleaned before leasing and a professional cleaning, receipt provided, is required for 100% deposit return.

Simply Rentals strives for this 100% return goal by providing clear and transparant communication, focusing on the core concept that tenants are responsible for expenses beyond the deterioration that occurs without negligence or abuse. Deductions from the security deposit, which we aim to avoid entirely, may include costs associated with cleaning, deodorizing, unpaid rent, late or other charges, or repairs for damages caused by the tenant. By diligently performing required maintenance throughout the tenancy and clearly communicating move-out expectations, we reduce the likelihood of deductions.
